The Family Law & Divorce team at Ashfords LLP solicitors explain how Resolution Together works for separating couples

When a relationship comes to an end, it’s not uncommon for couples to worry about the possibility of a drawn-out acrimonious process. Your relationship may have come to an end quite amicably, but you’ll be parents to your children together for the rest of your lives. You’ve built up your life and wealth together, therefore it’s natural that you may also want to approach separation mutually, amicably and with respect. This new approach helps support some couples, do just that.

What is Resolution Together?

Resolution Together is a relatively new approach that some specialist solicitors are now able to offer. A single solicitor can help you and your partner navigate your separation amicably – assisting you in resolving your disagreements constructively, supporting you both with disclosure, engaging any experts and crafting an agreement which is in the best interest of the entire family.

How is Resolution Together different?

Resolution Together involves both you and your partner instructing the same solicitor. You’ll both receive the same advice at the same time, and will be encouraged to work together towards an outcome which is fair to both of you. By contrast, traditional separation advice involves you each instructing your own solicitor to advise you with the view of negotiating a settlement with your partner’s solicitors.

How does it work?

The process can be tailored to your needs as a couple. One of our expert solicitors will direct the process, helping you to identify the issues between you which need to be resolved. They will assist and advise on the instruction of any other professionals to narrow the areas of disagreement, and answer any legal questions you may have. Once you have reached an agreement, your lawyer will be able to support you in documenting this into a legally binding order.

What are the benefits?

Resolution Together encourages collaboration. From day one, you’ll sit down with your partner and a knowledgeable expert to openly and honestly discuss your objectives, circumstances and finances, as well as the range of reasonable solutions. This can help to minimise the possibility of misunderstanding, encourage forthright and open communication, and increase the chance of amicable settlement.

Is Resolution Together right for my family?

There are some circumstances where Resolution Together won’t be appropriate. This includes instances of abuse, significant power imbalances, particular positioning or active conflict. The most important thing is that both parents feel emotionally ready to work together to solve disagreements, a willingness to be open and honest with each other, and a genuine desire to find a solution that is best for the whole family.
